The 11-month rent agreement is the most common rental contract in India — deliberately structured for 11 months to avoid the Rent Control Act applicability. The Transfer of Property Act and various state Rent Control Acts govern landlord-tenant relationships. Leases of 12 months or longer in several states attract Rent Control Act protections, which heavily favor tenants and make eviction extremely difficult. By keeping agreements to 11 months and renewing, landlords retain the ability to reclaim their property. Despite this, the agreement must be properly drafted to be enforceable.
Essential clauses in an Indian rent agreement: (1) Parties identification — landlord and tenant full names, Aadhaar/PAN, and addresses; (2) Property description — complete address, carpet area, furnishing details; (3) Rent and escalation — monthly rent amount, due date, annual increment percentage (typically 5-10%); (4) Security deposit — amount (typically 2-6 months rent), conditions for deduction; (5) Maintenance charges — who pays electricity, water, society charges; (6) Lock-in period — minimum period before either party can terminate; (7) Notice period for termination (typically 1-3 months); (8) Usage restrictions — residential use only, no sub-letting without permission; (9) Pet policy; (10) Dispute resolution — jurisdiction for legal disputes.
Rent agreements must be registered at the Sub-Registrar Office for legal validity — an unregistered agreement cannot be produced as evidence in court. Registration requires stamp duty (varies by state, typically ₹100-500 for 11-month agreements) plus registration fee. Notarized agreements (affidavit on stamp paper from a notary) are not the same as registered agreements but are commonly used for practical purposes. As of 2022-23, Maharashtra and several other states have launched e-registration portals for rent agreements, enabling home delivery of the registered agreement. TDS at 10% applies on monthly rent exceeding ₹50,000 (Section 194IB for individual landlords).

Common use cases
- Drafting an 11-month residential rent agreement for a flat in Bengaluru with ₹1.5L security deposit
- Creating a rent agreement that includes pet allowance clause and specific maintenance responsibility allocation
- Generating a rent agreement for a furnished flat specifying inventory of furniture and appliances
- Drafting agreement with lock-in period of 6 months and 3-month termination notice clause
- Creating a commercial premises rent agreement with GST clause (18% GST on commercial rent)
Tips for best results
- 1Always register the rent agreement — notarized agreements on stamp paper are not legally equivalent and cannot be produced as primary evidence in court
- 2Include a detailed inventory list of furniture and appliances as an annexure — with photographs if possible — to avoid security deposit disputes on exit
- 3The security deposit is not income for the landlord (it's refundable) but landlords who appropriate it without valid reason face legal liability
- 4Specify water and electricity connection names — if utilities are in the landlord's name and the tenant defaults on bills, the landlord bears liability to the utility company
- 5Include Aadhaar numbers of both parties — makes future KYC verification (for police verification, bank loans) significantly easier

- Why is a rent agreement made for 11 months and not 12 months?
- The Rent Control Acts in states like Maharashtra (Maharashtra Rent Control Act 1999), Delhi (Delhi Rent Control Act 1958), Karnataka, and Tamil Nadu provide strong tenant protection for leases. Once a tenant has occupied a property under a registered lease of 12 months or more, eviction becomes procedurally difficult — the landlord must prove specific grounds (non-payment, personal use, building demolition) before a Rent Controller. By capping at 11 months, the Transfer of Property Act applies (not Rent Control Act), making eviction significantly easier through a simple civil suit for possession. Technically, after the 11-month period, the landlord must serve notice and the tenant must vacate or a new agreement must be signed.
- Is a notarized rent agreement valid for HRA tax exemption?
- Yes — for HRA exemption claims, the Income Tax Department accepts notarized rent agreements along with rent receipts. The IT department's practical requirement is rent receipts + landlord PAN if annual rent exceeds ₹1L. A notarized agreement on stamp paper serves as documentary proof of tenancy for employer HRA declarations and ITR filing. However, for court proceedings, a registered agreement is required. Police verification (mandatory in most states within 24 hours of tenant moving in) also accepts notarized agreements. Most banks also accept notarized rent agreements for address proof.
- What are typical security deposit amounts across Indian cities?
- Security deposit norms vary significantly: Mumbai/Pune — 2 months rent typical; Delhi/NCR — 2-3 months; Bengaluru — 5-10 months (unique to Karnataka market; 10 months is common in areas like Indiranagar, Whitefield); Chennai — 5-10 months (similar to Bengaluru); Hyderabad — 3-5 months; Kolkata — 3-4 months. Karnataka and Tamil Nadu markets have historically higher deposits as an informal market practice rather than legal requirement. Legally, there is no mandated security deposit amount — it is negotiated between parties. The Bengaluru high-deposit market has come under scrutiny, and there are proposals to cap deposits at 2-3 months.
- What deductions can a landlord make from the security deposit?
- Landlords can legitimately deduct from security deposit: (1) Outstanding rent payments; (2) Utility bills (electricity, water) left unpaid; (3) Damage to property beyond normal wear and tear (broken furniture, damaged walls beyond normal discoloration, plumbing damage caused by tenant); (4) Cleaning costs if property left in significantly below-acceptable condition. Landlords CANNOT deduct for: normal wear and tear (minor wall scuff marks, aging fixtures), pre-existing damage not documented at move-in, or vague 'maintenance charges'. Tenants should always do a move-in walkthrough with the landlord and document the property condition with photos/video — creates strong evidence for security deposit disputes.
