Stamp duty is a state-level tax levied on property purchase agreements in India, payable at the time of property registration. Rates vary significantly across states: Maharashtra charges 5% for male buyers (3% for female buyers), Delhi 4%, Karnataka 5% (3% for women), Tamil Nadu 7%, Uttar Pradesh 7%, and Gujarat 4.9%. An additional registration fee of approximately 1% of the property value is charged separately under the Registration Act, 1908.

Female buyer concessions are one of the most impactful stamp duty discounts in India — Maharashtra saves female buyers 2% on crore-value properties, meaning a ₹1 crore flat saves ₹2 lakh in stamp duty. Several states also offer stamp duty exemptions for affordable housing (properties under ₹45L) and government housing schemes. Urban Development Authorities (UDA) and Municipal Corporation properties may also attract different rates depending on the jurisdiction.

Stamp duty must be paid via challan before property registration at the Sub-Registrar Office. Under-reporting property value to save stamp duty is illegal and can attract penalties up to 10 times the shortfall. E-stamping (through SHCIL — Stock Holding Corporation of India) is now mandatory in most states for high-value transactions. The stamp duty paid is eligible for deduction under Section 80C of the Income Tax Act (up to ₹1.5L combined limit in the year of payment).

Tips for best results

  • 1Register property in a female family member's name to save 1-2% stamp duty in most states — on a ₹50L property this can save ₹50,000-1,00,000
  • 2Pay stamp duty via e-stamping (SHCIL portal) rather than physical stamp papers for transactions above ₹500 — mandatory in most states
  • 3Do not under-declare property value for stamp duty — Sub-Registrars can refer cases to the Stamp Valuation Authority (SVA) for re-assessment
  • 4Stamp duty paid is deductible under Section 80C — keep the challan receipt and mention it in your ITR in the year of registration
  • 5Check for stamp duty amnesty schemes — Maharashtra, UP, and several other states periodically offer 50-100% waivers on residential properties below ₹45L

Is stamp duty the same across all Indian states?
No — stamp duty is a state subject under India's federal structure, and rates differ widely. Maharashtra: 5% (3% for women); Delhi: 4%; Karnataka: 5% (3% for women); Tamil Nadu: 7%; Uttar Pradesh: 7%; Gujarat: 4.9%; Rajasthan: 5-6%; Punjab: 5%; Telangana: 5%. Additionally, some states charge different rates for flats vs land vs commercial property. Always verify the current rate with the state's Stamps and Registration Department website before budgeting.
Can stamp duty be paid in installments?
No — stamp duty must be paid in full before or at the time of property registration. It cannot be paid in installments. However, some states allow provisional stamp duty payment (adjudication) before final registration. In Maharashtra, you can pay stamp duty online via the MahaStamp portal before going to the Sub-Registrar's office, which simplifies the process.
What is the stamp duty for property gifted to family members?
Gift deeds within family (spouse, children, parents, siblings) attract concessional stamp duty in most states. In Maharashtra, gift between blood relatives is charged at ₹200 flat stamp duty regardless of property value. Delhi charges 3% for gifts within family. Karnataka charges 5% even for family gifts. Always verify the current concessional rate with your local Sub-Registrar before executing a gift deed.
Is stamp duty refundable if a property deal falls through?
Yes, but with conditions. If a property deal is cancelled after stamp duty is paid but before registration, you can apply for a refund within specified time limits (varies by state — typically 2 years in Maharashtra). A deduction of 10% of stamp duty (minimum ₹100) is charged as cancellation fee. The refund process involves filing an application at the Collector of Stamps office with original stamp duty receipt, cancellation deed, and identity proof.
