Capital Gains Tax (CGT) in India is levied on profits from the sale of capital assets — stocks, mutual funds, gold, property, and bonds. The tax treatment differs significantly based on the type of asset and the holding period. Budget 2024 made landmark changes: LTCG rates were rationalised to 12.5% across most asset classes, the LTCG exemption on equities was raised to ₹1.25 lakh/year, indexation for property and gold purchased after July 23, 2024 was removed, and STCG for equities was raised to 20%.

For equity shares and equity mutual funds: profits held longer than 12 months are Long-term Capital Gains (LTCG) taxed at 12.5% above ₹1.25 lakh exemption per year. Profits held 12 months or less are Short-term Capital Gains (STCG) taxed at 20%. For debt mutual funds (post April 2023): all gains are taxed as per the investor's income slab, regardless of holding period — there is no LTCG benefit. For gold and property: STCG (< 24 months) is taxed at slab rate; LTCG (≥ 24 months) is now taxed at 12.5% without indexation.

Tax loss harvesting is an important strategy: realising losses before the financial year ends can offset capital gains and reduce tax liability. Equity LTCG losses can be offset against equity LTCG gains. STCG losses can be offset against either STCG or LTCG. The exemption limit of ₹1.25 lakh per year for equity LTCG is per individual — married couples can effectively double this by holding assets jointly or separately.

Common use cases

  • A mutual fund investor wants to calculate tax on redemption of ₹5 lakh in equity funds held for 18 months.
  • A stock trader is calculating STCG tax on intraday and delivery trades for the financial year.
  • A property owner sold a flat purchased in 2015 and wants to calculate LTCG — with or without indexation (for properties purchased before July 2024).
  • An investor is planning to harvest losses before March 31 to offset equity LTCG gains.
  • Someone is comparing the post-tax return from an equity fund (LTCG 12.5%) vs a debt fund (slab rate) to decide on asset allocation.

Tips for best results

  • 1Equity LTCG up to ₹1.25 lakh per year is tax-free. If you have gains above this, consider booking partial profits across two financial years to utilise the exemption twice.
  • 2Tax loss harvesting: before March 31, review your portfolio for unrealised losses. Selling these offsets gains and reduces overall tax. You can repurchase the same fund the next day if needed.
  • 3Debt mutual fund gains are fully taxable at slab rate from FY 2023-24. For investors in the 30% bracket, bank FDs (also taxed at slab) offer comparable post-tax returns with lower risk.
  • 4For property sold at a gain, invest the net capital gains in specified bonds (Section 54EC — NHAI, REC) within 6 months to defer LTCG tax up to ₹50 lakh.
  • 5NRIs are subject to TDS on capital gains at source. Obtaining a Tax Residency Certificate and Form 12BB can help claim treaty benefits.
