Notice period is the time between an employee's resignation and last working day, allowing organizations to plan for knowledge transfer and replacement hiring. In India, notice periods are defined in the employment contract and vary from 0-3 months for junior roles to 3-6 months for senior management. The typical IT industry standard is 2-3 months; BFSI and manufacturing often require 3 months; startups typically have 1 month. Notice period calculation starts from the date of resignation acceptance (or submission, per contract terms) and ends on the last working day.

Notice period buyout (also called 'notice pay in lieu of notice') allows employees to pay the company for the remaining notice period and exit immediately. Buyout cost = (Monthly CTC / 30) × Number of buyout days. For example, buying out 45 days notice at ₹1,20,000 monthly CTC = (₹1,20,000/30) × 45 = ₹1,80,000. This amount is paid by the employee to the employer and is not tax-deductible for the employee (it's a payment to the employer, not TDS or charity). Some new employers offer joining bonuses specifically to fund notice period buyout at previous employer.

Notice period waiver negotiation is a common practice in Indian IT industry. Employers can waive some or all of the notice period if the employee's role can be completed early or the replacement joins quickly. A handover completion letter and exit formalities clearance are typically the conditions for waiver. Notice period waiver is the employer's discretion — employees should formally write to HR/manager requesting waiver with reasons. Background verification from the new employer and relieving letter from the previous employer both depend on smooth notice period completion.

Common use cases

  • Calculating last working day from resignation date given a 90-day notice period with no buyout
  • Computing notice period buyout cost for leaving 45 days early on a ₹15L CTC package
  • Planning resignation timing to minimize buyout cost given a new employer's joining date requirement
  • Determining per-day buyout rate to negotiate a partial waiver with employer
  • Calculating remaining notice period days after accounting for pending earned leaves that can be adjusted

Tips for best results

  • 1Check if your offer letter allows adjusting earned/privilege leave balance against notice period — many companies allow it, effectively reducing buyout cost
  • 2Request a 'relieving letter' explicitly when completing exit formalities — do not leave without it; future employer background checks require this document
  • 3Notice period begins from the date the employer formally acknowledges resignation (check your contract) — some contracts specify notice begins from the date of delivery of resignation letter
  • 4Negotiate notice waiver proactively if you complete all project handovers — many managers agree to early release once critical knowledge transfer is documented
  • 5Keep copies of all resignation correspondence and exit clearances — disputes about notice period completion are common and email records are your best protection

Frequently asked questions

Is Konnect2Tools free?
Yes. These in-browser tools are completely free to use with no account required for core functionality.
Do my files leave my device?
Browser document operations run locally, except where the operation uses an external service, such as AI summarisation. Read the processing note before using sensitive inputs.

Local operations process document content on your device. External-service operations may send inputs as described in the processing note. Keep originals and inspect the output.
Can an employer extend notice period beyond what is in the contract?
No — notice period duration is governed by the employment contract. Employers cannot unilaterally extend notice period beyond the contracted period. However, if the contract has a 'mutual agreement' clause, employers may request extension. The Shops and Establishments Act in most states also specifies minimum notice periods (often 30 days) that cannot be reduced by contract for employees who have worked for a specified minimum period. Employees who leave before contractual notice period without buyout may face legal action for breach of contract, non-payment of full and final settlement, or delayed relieving letter.
Is notice period buyout amount taxable?
Notice period buyout paid by employee to employer is not directly taxable to the employee — it is a payment (not income). However, notice pay received by an employee (when employer asks employee to leave immediately and pays notice pay) is taxable as salary in the year received. For employers: if the company pays an employee to leave without serving notice ('garden leave pay' or 'pay in lieu of notice'), this payment to the employee is taxable salary income for the employee. TDS should be deducted by the employer on such payments. The outgoing employee must include it in Form 16 and ITR.
What is garden leave and how does it differ from notice period?
Garden leave (rare in India, common in UK-origin multinationals): employee serves out the notice period at home (does not come to office) but remains on payroll with all benefits. The employee cannot join a competitor during this time. Regular notice period: employee works in office during the notice period with active responsibilities. The term 'notice period' in Indian IT industry typically means working in office, completing handovers, knowledge documentation, and project transition. Garden leave is more common for senior roles (VP and above) where the company wants to restrict immediate competitor access while still paying for the notice period.
What if I resign but my employer does not relieve me on time?
Employers are legally required to issue relieving letters and full-and-final settlement within the contracted notice period. If employer is unresponsive: (1) Send registered letter/email formally requesting relieving; (2) File a complaint with the Labour Commissioner under the Shops and Establishments Act; (3) Send legal notice through an advocate. In practice, most IT/service companies process F&F settlement within 30-60 days of last working day. Delays in relieving letter can affect new job joining — communicate with new employer transparently; most will extend joining dates for pending relieving letters from established companies.
