Why 11 Months? The Registration Threshold

The most common rent agreement tenure in India is 11 months — not 12 months. This is because under the Registration Act 1908, rent agreements for 12 months or more are compulsorily registrable with the sub-registrar, incurring stamp duty (typically 2% of annual rent) and registration fees. An 11-month agreement falls below this threshold and can be executed on plain stamp paper with notarization.

For an annual rent of ₹3,00,000 (₹25,000/month), a 12-month registered agreement would cost approximately: Stamp duty (2%) = ₹6,000 + Registration fee = ₹1,000–3,000 + Notary charges = Total ₹7,000–10,000. The 11-month notarized agreement costs just ₹500–2,000 in stamp paper and notary fees.

However, 11-month agreements are automatically renewed and have limitations: without registration, proving the tenancy in court can be difficult. For high-value rentals, long-term residential arrangements, or commercial properties, registered agreements are strongly recommended despite the cost.

Essential Clauses Every Rent Agreement Must Have

Identity and property details: full names, addresses, ID numbers of both landlord and tenant. Complete property description including flat number, floor, society name, area, and registration details of the property. Missing or incorrect property description is a common cause of future disputes.

Rent and deposit: monthly rent amount, payment date, acceptable payment methods, and security deposit amount. Include clause on deposit refund timeline (typically 30–60 days after vacating) and permitted deductions (damage, unpaid bills). Specify whether rent includes maintenance or is separate.

Maintenance and utilities: who pays society maintenance, water charges, parking. Tenant typically pays electricity, gas, internet. Specify responsibility for minor repairs vs major structural repairs.

Notice period: standard is 30 days notice by either party for termination. Lock-in period (if any) during which neither party can exit. Specify whether notice must be written and by what means (email, WhatsApp, registered post).

Registered vs Notarized — Which Is Valid?

A notarized rent agreement is signed before a notary public who verifies identities and witnesses the signing. It has limited legal enforceability — primarily for proving the tenancy and month-to-month payments. Courts give it evidentiary value but it does not prevent disputes about specific clauses.

A registered rent agreement is stamped and registered with the sub-registrar. It is a public document, admissible in court as conclusive proof of the terms. For rent agreements exceeding 11 months, registration is compulsory.

For practical purposes: notarized 11-month agreements are sufficient for most residential rentals. For commercial rentals, high-value properties, or anywhere disputes are likely, register the agreement.
